I. NATURE OF SERVICE & NO WARRANTY AS TO OUTCOMES
The User acknowledges that Mahira Edge is a vocational training provider focusing on IT education (including but not limited to Data Science, SAP, Cloud Computing, and AWS) and is not a recruitment agency or a degree-granting university.
No Guarantee of Employment: Any reference to career prospects, salary increments, or placement assistance is strictly indicative. In accordance with the Indian Contract Act, 1872, our services are provided as a “Contract for Service” on a best-effort basis.
Performance Disclaimer: We do not warrant that the training will result in guaranteed employment, specific financial appreciation, or clearing of third-party certification exams. Success is contingent upon the User’s subjective application of skills and prevailing market volatility.
II. INTELLECTUAL PROPERTY & CRIMINAL BREACH OF TRUST
All proprietary pedagogy, curriculum, video recordings, software code, and digital assets are the exclusive property of Mahira Edge.
Limited License: Enrollment grants a non-transferable, revocable license for personal use only.
Legal Penalty: Any unauthorized recording, reproduction, or distribution of course materials shall be deemed a Criminal Breach of Trust under the Bharatiya Nyaya Sanhita (BNS) and a violation of the Copyright Act, 1957. We reserve the right to seek exemplary damages and injunctive relief.
III. NOMINATIVE FAIR USE OF TRADEMARKS
References to third-party trademarks (including SAP, AWS, Google, Microsoft, Meta, etc.) are made strictly for educational and nominative purposes as permitted under the Trademarks Act, 1999. Mahira Edge disclaims any official affiliation, sponsorship, or endorsement by these trademark owners unless explicitly stated in writing.
IV. UNILATERAL RIGHT TO MODIFY SERVICES
Mahira Edge reserves the absolute and unilateral right to modify course curriculum, technical stacks, instructor assignments, and the mode of delivery (Online/Offline/Hybrid) without prior notice. Such modifications are deemed necessary to maintain industry relevance and do not constitute a “Deficiency of Service” under the Consumer Protection Act, 2019.
V. LIMITATION OF LIABILITY & FORCE MAJEURE
To the maximum extent permitted by law, Mahira Edge shall not be liable for any indirect, incidental, or consequential damages, including loss of data, loss of profit, or opportunity costs. We are further absolved of liability in events of Force Majeure, including internet disruptions, cloud server failures (AWS/Azure/SAP), or government-mandated restrictions.
VI. TESTIMONIAL INTEGRITY & CAVEAT EMPTOR
Testimonials represent individual subjective experiences and are not a guarantee of “Typical Results.” The principle of “Caveat Emptor” (Buyer Beware) applies; the User is expected to perform independent due diligence before enrollment.
VII. TAXATION & STATUTORY LEVIES
All fees are subject to the prevailing Goods and Services Tax (GST) and other statutory levies as mandated by the Government of India. Any retrospective or future change in tax laws shall be the sole liability of the User.
VIII. DATA PRIVACY & EXPRESS CONSENT
By engaging with our services, the User provides “Express Consent” as defined under the Digital Personal Data Protection (DPDP) Act, 2023, for the collection and processing of personal data for educational and administrative purposes as detailed in our Privacy Policy.
IX. ANTI-COLLUSION & PROHIBITION OF COMPETITIVE DATA SHARING
Strict Prohibition: Any sharing of Mahira Edge curriculum, internal notes, project datasets, or student information with other educational institutes, competitors, or third-party training entities is strictly prohibited.
Legal Action: Such an act shall be treated as Industrial Espionage and a breach of confidentiality.
Penalty: We reserve the right to terminate access immediately without refund and initiate criminal proceedings for “Criminal Conspiracy” and “Theft of Trade Secrets.”
X. OPERATIONAL ERRORS & CLERICAL MISTAKES (Team Safety)
Error Correction: Mahira Edge shall not be held liable for accidental clerical errors, typographical mistakes, or omissions in course schedules, fee receipts, or digital communication.
Cure Period: If a team member fails to deliver a service (e.g., login access to SAP/AWS labs) on time, Mahira Edge shall be granted a “Cure Period” of 7 working days to rectify the error before it is considered a breach of service. No claims for damages shall be entertained for such operational delays.
XI. LIMITATION ON VICARIOUS LIABILITY
Mahira Edge shall not be vicariously liable for any unauthorized promises or personal opinions made by individual employees, mentors, or support staff that go beyond the official written scope of the program. Only terms mentioned on the official Mahira Edge website or in signed, stamped offer letters are binding.
XII. SEVERABILITY & NON-WAIVER
If any provision is held invalid or unenforceable by a court of competent jurisdiction (Thane), the remaining sections shall continue in full force and effect. Failure to enforce a right does not constitute a waiver of that right.
XIII. OUSTER CLAUSE & GOVERNING LAW (Exclusive Jurisdiction)
This agreement is governed by the laws of the Republic of India. In the event of any dispute, claim, or litigation, the parties hereby irrevocably submit to the exclusive jurisdiction of the Courts in Thane District, State of Maharashtra, India, to the exclusion of all other courts or forums.
